The H-1B program establishes standards to protect both U.S. workers and nonimmigrant foreign national workers. A computer consulting company based out of Suwanee, Georgia has agreed to pay $1 million in back wages and interest to approximately 135 nonimmigrant workers who were temporarily employed with the company under the H-1B visa program. A Wage and Hour Division for the Department of Labor (DOL) investigator found that some employees of Smartsoft International Inc. were not paid wages at the beginning of their employment, were being paid a part-time salary when working full-time, or were being paid less then what they should have based on geographic location.
