J-1 Exchange Visitor Visa – International Visitors

 1. Definition of J-1 Exchange International Visitors. 22 C.F.R. § 62.4 (h).

A J-1 Exchange International Visitor is an individual who is a recognized or potential leader, selected by the Department of State for consultation, observation, research, training, or demonstration of special skills in the United States.

2. Purpose of J-1 International Visitor Program. 22 C.F.R. § 62.28 (a).

The J-1 international visitor category is for the exclusive use of the Department of State. Participants engage in observation tours, discussions, consultation, professional meetings, conferences, workshops, and travel. J-1 International Visitor programs are designed to enable the international visitors to better understand American culture and society and contribute to enhanced American knowledge of foreign cultures. This category is for “people-to-people programs,” which seek to develop and strengthen professional and personal ties between key foreign nationals and Americans and American institutions.

3. Criteria for J-1 International Visitors. 22 C.F.R. § 62.28 (c).

To participate in an exchange visitor program as an international visitor, an individual must be:

  • Selected by the Department of State;
  • Engaged in consultation, observation, research, training, or demonstration of special skills; and
  • A recognized or potential leader in a field of specialized knowledge or skill.

4. Location of J-1 International Visitors Activity. 22 C.F.R. § 62.28 (f).

A J-1 international visitor may only participate in an exchange visitor program at the locations approved by the Department of State.

5. Duration of J-1 International Visitor Participation. 22 C.F.R. § 62.28 (g).

The J-1 international visitor stay in the Exchange Visitor Program is limited to the length of time necessary to complete the program, which may not exceed one year.

6. J-1 International Visitor Sponsor Obligations. 22 C.F.R. § 62.28 (d).

At the beginning of the program, the J-1 International Visitor Sponsor must provide the international visitor with:

  • Information on the length and location(s) of his or her exchange visitor program; and
  • A summary of the significant components of the program.
