DELAYS with EAD and Advance Parole Processing

August 5th, 2010 by Brian D. Zuccaro

SRW has noticed recent significant delays with EAD and Advance Parole processing out of the Nebraska Service Center. Part of the problem is the transition to using lockboxes as the initial filing and processing point for these applications.

Based on these delays, it is important to file both applications as soon as possible within the 120 day period before each current document expires. Unlike timely filed non immigrant extension applications, foreign nationals are not work authorized while a timely filed extension of an EAD is pending, after the current EAD expires. If an EAD has been pending for more than 75 days, there are procedures available to place an inquiry on processing.
