F2A Spouses & Children of Permanent Residents Becomes Current
July 22nd, 2013 by SRW Lawyers
The August 2013 Visa Bulletin shows that family-based 2A category, spouses & children of permanent residents, has now become current. The Visa Bulletin reads that “F2A: This category has become “Current” for August, and is expected to remain so for the next several months. This action has been taken in an effort to generate an increased level of demand. Despite the fact that there are large amounts of registered F2A demand, currently there are not enough applicants who are actively pursuing final action on their case to fully utilize all of the available numbers.”
This means that spouses of permanent residents who are in lawful status in the U.S. may now be eligible to concurrently file 130/485 paperwork to pursue a green card from within the U.S. While this category is current, there is no need to only file the I-130 and wait for the priority date to become current.
This will be particularly beneficial to those in nonimmigrant status who are married to a permanent resident but who were holding off on pursuing any green card paperwork because of the delay. Now that the F2A category is current, those individuals may concurrently file 130/485 paperwork and proceed just as quickly as those who are married to U.S. citizens.
