H-1B CAP Filings Still Accepted as of July 8, 2009

CIS announced that it continues to accept H-1B nonimmigrant visa petitions subject to the fiscal year 2010 cap. CIS will continue to monitor the number of H-1B petitions received for both the 65,000 regular cap and the 20,000 U.S. master’s degree or higher educational exemption cap.

CIS announced that it received approximately 42,000 H-1B petitions counted towards the regular cap and about 20,000 H-1B petitions counted towards the U.S. advanced degree cap. CIS will continue to accept U.S. advanced degree cap cases becasue hsitory shows that not all of those filings are approvable.

CIS also announced that the 15-day premium processing window for cases filed for April 1st delivery began on April 7th.

 

Update as of April 21, 2009

On April 20, 2009, CIS updated the count of H-1B petitions received and counted towards the H-1B cap on its website. As of April 20, 2009, approximately 44,000 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed.

 

Update as of May 7, 2009

CIS announced on May 4th that it has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. CIS continues to accept petitions subject to the general cap.

 

Update as of May 11, 2009

As of May 11, 2009, approximately 45,000 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. CIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

 

Update as of May 18, 2009

 

As of May 18, 2009, approximately 45,500 H-1B cap-subject petitions had been received. CIS continues to accept petitions subject to the general cap. Also, it has received approximately 20,000 petitions qualifying for the advanced degree cap exemption. CIS will continue to accept advanced degree petitions, stating that experience has shown that not all petitions received are approvable.

 

Update as of May 26, 2009

On May 26, 2009 USCIS updated the count of H-1B petitions received and counted towards the H-1B cap on the USCIS website. As of May 22, 2009, approximately 45,700 H-1B cap-subject petitions had been received. Also, USCIS has received approximately 20,000 petitions qualifying for the advanced degree cap exemption. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.

 

Update as of June 19, 2009

As of June 19, 2009, approximately 44,500 H-1B cap-subject petitions had been received by USCIS and counted towards the H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.

 

Update as of June 26, 2009

As of June 26, 2009, approximately 44,800 H-1B cap-subject petitions had been received by USCIS and counted towards the H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.

 

Update as of July 3, 2009

As of July 3, 2009, approximately 45,000 H-1B cap-subject petitions had been received by USCIS and counted towards the H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.
