I-129F Fiancé Petition Approved in 48 Days by USCIS
October 24th, 2013 by Nisha Fontaine
Recently, a young couple approached us and expressed their desire to marry each other and eventually relocate to the United States to begin their life together (at the time, the couple resided abroad together). Based on their intent to have a formal wedding ceremony in the U.S. and given their proposed timelines, we recommended that the couple proceed with the fiancé visa route (a two-step process – first, file Form I-129F with USCIS and upon approval, complete the K-1 visa process through U.S. Consulate abroad).
The couple agreed and asked us to represent them through this process. We quickly prepared and submitted the I-129F petition package to USCIS on August 7th of this year – the petition was approved (without the issuance of a Request for Evidence [RFE]) on September 24th – just 48 days later, at a time when processing times were closer to 5-6 months. The speedy adjudication and favorable outcome of this I-129F petition can be significantly attributed to the substantial amount of varied documentary evidence demonstrating the legitimacy of the couple’s relationship that we were able to include in the submission as well as ensuring that all the required documentation was properly submitted, including letters confirming the couple’s intent to marry each other within 90 days of the foreign national’s entry into the U.S. with a K-1 visa. The next step for the couple is to pursue a K-1 visa through the appropriate U.S. Embassy/Consulate – for additional information about this process, please click here and here.
While not all I-129F’s can be adjudicated this quickly, this approval does highlight the importance of ensuring that the petition is properly and accurately completed and that all the necessary documentation is submitted, to assist with the fastest possible favorable adjudication.
