SRW Attorney Nisha Fontaine’s Article on Non-Immigrant Waivers Published in Toronto Newspaper

One of our associate attorneys, Nisha V. Fontaine, has published an article on Non-Immigrant Waivers in a local Toronto, Ontario, Canada newspaper – Weekly Times of India. An excerpt of the article follows:

For many years, our law firm has been working with foreign nationals who share a common background: first attempted to immigrate to the United States, struggled and failed to obtain legal status and eventually obtained legal status in Canada and are now firmly resettled in Canada. Many of these individuals also share a common wish: to re-enter the United States – whether it be for family vacations/attend important family occasions (B-2), to explore investment opportunities (E-1/E-2), and/or to explore employment opportunities (H-1B, TN, L-1, etc.). However, many of these individuals face a common hurdle – their inability, whether temporary or permanent, to enter the United States based on their past U.S. immigration history. The inability to enter the U.S. could stem from unlawful presence bars, previous removal orders, past fraud/misrepresentation charges – which are all grounds of inadmissibility under the Immigration and Nationality Act (INA).

The good news is that there is still an option available to most of those individuals: non-immigrant waivers to overcome inadmissibility and enter the U.S. for temporary purposes.

This article will explain two types of waivers available: one waiver to allow them to apply to enter the U.S. even though they are inadmissible to the U.S.; and, another waiver to allow them to reapply for admission to the U.S. after being removed. Some need only one of these waivers, others may need both.
