DHS Creates New Process for Provisonal Unlawful Presence Waiver

The Department of Homeland Security (DHS) has developed a new procedure that will allow qualifying immediate relatives of a U.S. citizen to apply for a provisional waiver while they are still in the United States before departing for their immigrant visa interviews abroad. USCIS anticipates that this new procedure will drastically reduce the amount of time that these immediate relatives are separated from their U.S. citizen spouses, parent and children.
